Introduction

Are often referred to as Medical legal assessments or personal injury medical examinations. They are chosen by the lawyers or the insurance company to assess your level of disability or impairment ratings.

A medico-legal evaluation is a medical assessment used as evidence in a legal case. After the examination, the doctor prepares a detailed report. If the status says "Report Waiting", it means the examination is complete, but the written report is still pending.

Medico-Legal Evaluations and Report Waiting

Refers to a stage in a medico-legal matter where:

  • A medical examination or assessment has already been conducted by a healthcare professional.
  • The assessment is intended for a legal purpose, such as a personal injury claim, medical negligence case, motor vehicle accident claim, disability claim, or compensation matter.
  • The medical report has not yet been completed or submitted, and the case is awaiting the doctor's written findings and expert opinion.

What is a Medico-Legal Evaluation?

  • Purpose: It provides an objective, evidence-based medical opinion for legal proceedings, such as personal injury claims, road accident fund (RAF) claims, worker's compensation, medical negligence, or civil and criminal cases.
  • The Process: It typically involves a thorough review of past medical records, a comprehensive interview with the claimant, and a physical, mental, or functional capacity examination.
  • The Output (The Report): The expert compiles their findings into a formal written report detailing the extent of the injury or disability, causation, future treatment requirements, and a financial or functional breakdown (often including a quantification of damages or future care costs).
